My African Box is a company dedicated to bringing you 100% African products every month. As an LTD, we are committed to providing our customers with high quality products while highlighting the richness and diversity of African cultures.
The main means of communication between you and the company is via the website www.myafricanbox.org. On this site, you’ll find our subscription services, which entitle you to between 2 and 5 products of African origin (depending on the subscription formula chosen).
A meticulous selection of products is made by our team to guarantee you a direct flight to the mother continent every month. Individual purchase of certain products is also possible.
These general terms and conditions of sale have been drawn up and made available to you to govern exchanges between My African Box and you (visitors, customers, registered users), in particular access to and use of our portal.

Our terms and conditions apply only to customers who have placed an order with us.
Before placing an order, the customer must have accepted the company’s general terms and conditions of sale. Once you have read these terms and conditions, you can choose whether or not to accept them.

Clarification of certain topics

Subscription: A subscription is a contract between the customer and the My African Box company for the regular supply of products. The supply and reception of these products takes place according to the conditions defined in the general sales conditions.
We offer two subscription formulas (classic formulas): a monthly subscription (one month) automatically renewable for the following month (automatic renewal is planned once), and a quarterly subscription (three months) prepaid with commitment. Renewal of the latter (quarterly subscription) requires customer approval.

Gift subscriptions: Gift subscriptions are subscriptions offered to a third party by a supplier, usually for a limited period. For example, for three months, six months or 12 months; the recipient of the gift subscription may receive the same products as regular subscribers, or products specially selected for the gifts.

Box: Boxes are packages of products sent regularly to subscribers or customers who wish to receive our selection of products. All My African Boxes include a variety of products of 100% African origin.

Orders: Orders refer to requests from customers or subscribers to take out subscriptions, individual products and free boxes (excluding subscriptions).
The placing and validation of orders on the site must take place in accordance with the conditions set out in the T&C.Non-subscription orders:Non-subscription orders are orders for individual products, requested by customers or subscribers outside their regular subscription.

Customers : Customers are persons who purchase products from the My African Box company website.

Non-subscription orders: Non-subscription orders are orders for individual products requested by customers or subscribers outside their regular subscription.

Customers: Customers are people who buy products on the My African Box website.

Subscribers: Subscribers are customers who have taken out a subscription to receive product boxes over a given period of time.

Personal account: The personal account is a dedicated space on the My African Box website where customers can access their profile, order history, current subscriptions, as well as other features related to their account such as delivery times.

Special offers: Special offers are temporary promotions or discounts offered by our company to visitors, customers or subscribers according to a certain number of criteria. These offers may include price reductions, free gifts or other benefits.

Visitors: Visitors are people who browse the My African Box website without necessarily purchasing a product or subscribing to a membership.

Personal data: Personal data refers to customer or subscriber information such as name, address, e-mail address, telephone number, gender, bank details, purchase history, product preferences etc.

Portal: The portal is a digital platform that serves as a single point of access for customers and subscribers.

Suppliers: These are the producers or brands whose products will be included in the box and sold individually.

Purpose of the General Conditions


The purpose of these General Terms and Conditions of Sale is to govern exchanges between My African Box and its customers, visitors and subscribers, and to inform the latter of the rights and obligations of each party, while ensuring the transparency of transactions and the protection of personal data. They define the terms and conditions of sale, use, payment, delivery and dispute management.

Acceptance of our Terms and Conditions

The use of services and products offered by My African Box implies full acceptance of these terms and conditions of sale. These conditions apply primarily to subscribers, customers and visitors to the My African Box website.
By subscribing to My African Box, the customer acknowledges having read these terms and conditions of sale and accepts them without reservation. In fact, by checking the box “I accept the Terms and Conditions” that appears when you subscribe to a subscription or purchase a product, you agree to be fully bound by My African Box’s terms and conditions of sale. If you do not agree to these conditions, we recommend that you do not subscribe to one of our subscription packages or place an order from our company’s website.

My African Box reserves the right to modify these terms and conditions at any time. Our team will inform customers and subscribers of any changes made. For monthly subscriptions, these new clauses will take effect at the beginning of the following month.

In the event of non-compliance with these terms and conditions, My African Box reserves the right to suspend or terminate the subscription contract with immediate effect, without any claim for damages.

By accepting these terms and conditions, the customer declares that he/she has the legal capacity to enter into a contract with My African Box, and that he/she has reached the age of majority in his/her country of residence.

General disclaimer

Use of company site: My African Box cannot guarantee that use of its site will be uninterrupted or error-free, and will not be liable for any damages or losses resulting from use of its site.

My African Box reserves the right to modify, suspend or terminate any service or feature of its website, including access to third-party websites, at any time without notice.

Accessing and using the portal

At My African Box, we strive to provide our customers with the best possible experience when using our site. We are committed to ensuring that our site is accessible at all times and from any device, and we are constantly working to improve the quality of our online service. Access to our site requires a stable internet connection compatible with the technologies we use. We are not responsible for any connection or access problems that may arise due to circumstances beyond our control, such as network outages or technical problems with your internet service provider.

My African Box is committed to ensuring maximum availability of its site. However, as part of the regular maintenance of our site or for any other technical reasons, access to it may be temporarily interrupted. To access our subscription service, we ask our customers to create an account. We encourage our customers to provide accurate, up-to-date and truthful information when creating their account to avoid any subsequent problems. We are not responsible for delivery delays or errors caused by inaccurate information provided by the customer. We also reserve the right to terminate or cancel any contract with a customer if we find that false information has been provided intentionally or unintentionally, or if the customer has breached the terms and conditions of our subscription service. In this case, we will inform the customer by email or any other appropriate means and refund any sums paid for undelivered boxes, after deduction of management and logistics costs.

At My African Box, we make every effort to ensure the security and privacy of our customers’ personal information. We use advanced security technologies and procedures to protect our website and the information stored on it. However, we cannot guarantee 100% security of information transmitted over the Internet, and we are not responsible for any loss or theft of such information due to hacking or other malicious acts. We encourage our customers to take the necessary security measures to protect their personal information, such as using high-level passwords and connecting only to secure wifi networks.

We would also like to emphasize that use of our website must be in strict compliance with our terms and conditions and with all applicable laws. We do not tolerate any illegal or harmful activity, such as copyright infringement, the distribution of viruses or malware, or any other activity likely to disrupt or damage our website or the services we offer. We reserve the right to suspend, terminate or take legal action against any customer who violates these rules, without notice or compensation.

The My African Box site was created for residents of the United States and France. Use of the site outside of these countries is possible, but My African Box does not guarantee that access to the site will be easy or even possible. The customer acknowledges that access to the site from other countries may be restricted or prohibited due to local laws or regulations. Customer is responsible for verifying that use of the Site is permitted in its country of residence and assumes all risks and liability related to use of the Site in any jurisdiction where access is restricted or prohibited.

My African Box shall not be liable for any damages resulting from the use of the site in violation of local laws or regulations in force in the jurisdiction where the customer resides. In addition, My African Box does not warrant that the site will be compatible with laws or technical standards applicable outside the United States and France.

By accepting the terms and conditions of use of the My African Box site, the customer acknowledges and agrees that use of the site outside the United States and France may be limited or prohibited, and that My African Box shall not be liable for any damages resulting therefrom. Additional charges (special pricing) may apply outside the country covered by our offer.

Site forbidden to minors

At My African Box, we are concerned about the protection of children and their safety online. Therefore, our website is intended for use by persons 18 years of age and older only. We encourage parents and guardians to monitor their children’s use of the Internet and to educate them about good online safety practices.

How subscriptions work

My African box offers subscriptions to products and services.

Each month, you receive a selection of 2 to 5 products (depending on the package chosen), additional accessories and a descriptive magazine. The products selected vary each month. The choice of products is based on a number of technical aspects, and above all on your preferences (over the long term).virtuel descriptif. Les produits sélectionnés varient chaque mois. Chez My African Box, les visiteurs peuvent choisir entre deux formules d’abonnement.

Payment is by the month. The customer will not be charged in full, but per month for the number of months of subscription.
Customers will be asked to register their payment details for direct debit, but they also have the option of paying on time following notification or a reminder from our customer service department. Late payment may incur penalties.

Customers may cancel their monthly subscription 6 days before the start of their box delivery. A partial refund will be made by the company for certain costs incurred. After delivery, customers may cancel their order, but will not receive a refund from our company. Customers will be notified of all scheduled delivery dates.

Cancellations can be made directly on the site in the “my account” field..

The second formula is a firm 3-month subscription, renewable only at the customer’s express request. We would like to emphasize that our fixed-term subscriptions cannot be cancelled (once payment has been made). By subscribing to one of our subscriptions, you agree to pay the full amount due for the entire duration of the subscription, even if you decide to cancel it early. Cancellation is only possible at the end of the first three months of subscription.

We remind you that payment is final and cannot be reimbursed or discounted in the event of early termination. We therefore invite you to think carefully before subscribing to one of our fixed-term offers, and to ensure that you are in a position to bear the costs for the entire duration of the subscription.

If an order cannot be shipped for reasons beyond the company’s control, My African Box reserves the right to cancel the order and reimburse the customer. The customer will be informed of this cancellation and the corresponding reimbursement, as well as the timeframe for reimbursement.

Our gift subscriptions, lasting from 1 to 3 months, are an excellent way to offer an original and surprising gift to your loved ones. However, it is important to note that they are subject to the same terms and conditions as our previous subscriptions. For gift subscriptions, it is necessary to enter the recipient’s e-mail address and delivery address. The customer alone is responsible for the accuracy of the beneficiary’s information. My African Box cannot be held liable for any consequences resulting from the communication of inaccurate information.
The customer can define the duration of his gift subscription.

My african box also offers special box subscriptions. These boxes are made up of products from a very specific category (cosmetics from Africa, spirits from Africa, culinary specialties from Africa…). The subscription formulas for these boxes are the same as those for classic boxes, and comply with the same conditions. The only difference is that prices may vary.

Referral system

In this system, every customer who succeeds in bringing a new customer to the platform is offered a benefit (purchase coupon). To benefit from this advantage, the new customer must notify the referral code of the former subscriber when registering on the website. The same system also applies to new subscribers who wish to benefit from these advantages.
This referral system is only valid in the case of a subscription made by the referred person. The purchase coupon only entitles the recipient to a free voucher. If delivery of the chosen product(s) requires delivery charges, these will be borne by the coupon recipient.

Orders for products/boxes excluding subscriptions

On the My African Box company website, customers can buy individual products, without a subscription, and order a box without a subscription. Customers can select the desired products, add the items to their basket and finalize their order by proceeding to payment. Prices are in US dollars and include applicable taxes. Once payment has been made, the order is validated and the customer receives an order confirmation by e-mail, containing a summary of the items ordered and delivery information.

If the customer wishes to cancel his/her order, he/she may do so 72 hours before the order is due to be dispatched. To cancel the order, the customer must contact the company’s customer service department by e-mail or telephone, specifying the order number and the items concerned.
A partial refund is possible if cancellation is requested 3 days before the scheduled delivery date. Orders cancelled after delivery cannot be refunded by My African Box.

Fraud is strictly prohibited on the My African Box website and in connection with all services and products offered by the company.

All attempts at fraud, including but not limited to identity forgery, data manipulation, use of fraudulent payment methods or any other fraudulent activity, will be reported to the appropriate authorities and prosecuted.

My African Box reserves the right to cancel any suspicious or fraudulent order or transaction, and to immediately suspend or terminate the account of any customer involved in fraudulent activity, without notice or refund.
In the event of cancellation of an order by the company, the customer will be informed and the amount paid will be refunded as soon as possible.

Customers are responsible for the security of their account and payment information, and must notify My African Box immediately of any suspicious or unauthorized activity on their account or payment method.

My African Box will not be liable for any loss or damage suffered by customers as a result of fraudulent activity on their account or payment method.

Product information

The products included in the box are supplied by partner brands and are not manufactured by the company. The information provided on the products, including ingredients, allergens, instructions for use and warnings, is that communicated by the product suppliers. Although the company cannot guarantee the accuracy of this information, it makes every effort to provide its subscribers with exceptional, quality products.

The company works with brands renowned for their quality and expertise, and carries out regular checks to ensure that products delivered meet its quality standards. Subscribers are invited to consult the websites of partner brands for more detailed information on the products included in their box. Subscribers are also advised to read product labels and instructions carefully before use, and to take into account their own food allergies and intolerances.

By using the products included in the box, subscribers accept the information provided by the partner brands and use the products at their own risk.

Consequently, My African Box cannot be held responsible for allergic reactions or other health problems resulting from the consumption of products included in its boxes. If you have any problems or questions, we recommend that you contact the product manufacturer directly. We will provide you with all information concerning the manufacturers.

Product descriptions provided on the company’s website are for information purposes only and do not constitute contractual offers.
Product images presented on the company’s website are also provided for information purposes only and may differ from actual products in terms of color, shape and size. The company cannot be held responsible for minor differences between product images and actual products.

The subscription box company strives to offer its subscribers quality products every month. However, the availability of products included in the box may vary according to seasonality, product availability from suppliers and consumer demand. The company reserves the right to replace a product with another of equivalent value if the product initially planned is not available as part of a customer order. The replacement will be made if the customer accepts it. The customer may refuse the replacement product. In this case, the company will refund all sums paid.
My African Box is solely responsible for estimating the value of a product and selecting a replacement.

 Prices


Prices displayed on the My African Box website for box subscriptions and products sold are in US dollars and include all applicable taxes. The prices displayed at the time of validation of the subscription or purchase are the total prices, which include delivery and processing fees, unless explicitly stated otherwise.


Payment terms and security

Payments are generally made to My African Box by credit card, Mastercard, Paypal and bank transfer.
For product orders and box purchases other than subscriptions, we will debit the total amount from the website. After validation of the order and payment, you will receive an invoice on the customer’s personal account or directly in the parcel they receive on delivery.

For fixed-term subscriptions (quarterly and gift subscriptions), payment is made in full at the time of ordering. The total amount will therefore be debited in full. Once the subscription has been validated and payment made, the subscriber will receive an invoice from My African Box in their personal account or by e-mail.

For monthly subscriptions, the first month will be billed manually. For the second and subsequent months (in the event of renewal), payment will be debited automatically. Once the subscription has been validated and payment has been made, the customer will receive an invoice from My African Box on his/her personal My African Box account.

Personal information such as credit card number, expiration date, credit card security code, name of credit card holder, Paypal account, account creation email, IBAN (International Bank Account Number), BIC (Bank Identifier Code)… will be required.

Security

In the event of non-payment by the Customer, the Company reserves the right to immediately cancel the current order or subscription. The Customer will be informed of this suspension by e-mail and will have 7 (seven) days to rectify the situation. Once this period has elapsed, the Company may terminate the current subscription or sales contract, without prejudice to any damages that may be claimed in compensation for the loss suffered.

In the event of non-payment of sums due, the Company also reserves the right to use all legal means of collection, including the seizure of all securities, at the Customer’s expense.

Non-payment of any of the due dates shall automatically entail, without notice of default, immediate payment of all sums due, together with the penalties for late payment applicable in accordance with the general terms and conditions of sale.
At the same time, we ask you to exercise extreme caution when making payments, and not to rely on any source or procedure other than that strictly set out by My African Box, without which we cannot be held responsible for any disappointment whatsoever.

Delivery

Zones de livraison : Les livraisons sont limitées aux adresses en France et aux Etats-Unis. Les colis sont livrés à domicile. Home delivery will be made if your address is clear and accessible. If this is not the case, please go to your nearest post office/usps.

Frais de livraison : Les frais de livraison sont calculés en fonction de la zone géographique de livraison et sont clairement indiqués lors du processus de commande. Ces frais s’ajoutent au montant total de la commande.

Quality guarantee: The Company can guarantee the quality of its products by offering guarantees on the lifespan, operation or performance of products or services.

In the event of physical alteration observed during use, the customer has 7 days from receipt of the order to report the problem to the Company by e-mail at the following address: Ourbox@myafricanbox.org

For the quality guarantee to apply, the customer must return the altered product to the Company (to the address from which the products are dispatched) within 14 days of receipt of the order. The return costs are incurred by the customer pending reimbursement.

After examining the returned product, the company will either replace the product or refund the amount paid for the altered product, according to the customer’s choice and as soon as possible.

The company reserves the right to refuse any request for a refund or replacement if the customer does not comply with the above conditions.

Upon delivery of the package, the customer is required to inspect the contents of the box. He has the right to refuse the parcel if the products do not conform to his order.

The customer acknowledges that My African Box cannot be held responsible for any loss or damage resulting from the unauthorized use of the customer’s account due to the disclosure of the customer’s password to third parties or the customer’s own negligence in managing the customer’s password.

The customer must immediately (without delay) report to My African Box any unauthorized use of his account or any breach of security, including any unauthorized use of his password or any attempt at hacking. This report must be made via the company’s e-mail address, and the customer must include all personal information (surname, first name, old password, zip code, town, number, etc.). My African Box will then take the necessary steps to update or suspend the use of the password.
